Abstract
La Corte costituzionale ha riaperto il dibattito sui diritti sociali. In particolare, in merito al rapporto tra “sostenibilità economica” e “sostenibilità sociale”, la Corte ha evidenziato come il principio dell’equilibrio di bilancio non possa essere concepito come un valore destinato a prevalere sugli altri valori di rilevanza costituzionale.
Socio-economic Sustainability and Constitutional Legitimacy (Still Talking of the Judgment no. 70 of 2015)
The constitutional Court has reopened the debate on the social rights. Particularly, regarding the relationship among “economic sustainability” and “social sustainability”, the Court has underlined as the principle of the equilibrium of budget cannot be conceived as a value destined to prevail on the other values of constitutional importance.
