Abstract
Il saggio esamina, alla luce della regolamentazione del lavoro agile “ordinario e/o fisiologico” di cui alla legge 22 maggio 2017, n. 81, la recente incentivazione del lavoro agile collegato alla pandemia, le prospettive collegate all’uscita dall’approccio emergenziale dell’istituto e le implicazioni di un possibile “lascito” delle norme emergenziali per una futura regolamentazione dell’istituto. Ciò in uno scenario estremamente complesso che vede all’orizzonte diverse strade: un graduale “riassorbimento totale” del lavoro agile oppure un uso come forma “normale” di lavoro o, infine, un “modello di lavoro misto” tra “presenza e lavoro agile”. Il saggio, inoltre, evidenzia la necessità di raccogliere l’eredità del lavoro agile emergenziale attraverso un ritorno alla disciplina “pre-pandemia”, in quanto la deroga al regime della consensualità (che traeva la sua giustificazione da finalità di ordine pubblico sanitario) non potrà probabilmente riprodursi una volta terminata la fase emergenziale. Da qui parte il tentativo di ricercare un possibile nuovo ruolo dell’autonoma collettiva che sappia far tesoro della esperienza emergenziale.
Remote Working beyond the Emergency
The essay examines, in the light of the regulation of “ordinary and / or physiological” smart work pursuant to law no. 81, the recent incentive for smart work linked to the pandemic, the prospects related to the exit from the institution’s emergency approach and the implications of a possible “legacy” of the emergency rules for future regulation of the institution. This in an extremely complex scenario that sees different paths on the horizon: a gradual “total reabsorption” of smart work or use as a “normal” form of work or, finally, a “mixed work model” between “presence and smart work”. The essay also highlights the need to collect the legacy of emergency smart work through a return to the “pre-pandemic” discipline, as the derogation from the consensual regime (which drew its justification from public health order) does not it will probably reproduce once the emergency phase is over. Hence the attempt to seek a possible new role for the autonomous collective that knows how to treasure the emergency experience.
